Terms of service
Terms of Service
Last updated: 15 October 2026
Overview
Welcome to Nae Scotland, Nae Party.
These Terms of Service explain the conditions applying when you browse our website, use our online store or purchase our products for delivery within England, Scotland and Wales.
The words “we”, “us” and “our” refer to Nae Scotland, Nae Party, a trading name operated by Allan Muir from Singapore.
Our online store is powered by Shopify, which provides the e-commerce platform through which we offer our products.
These Terms should be read alongside our Privacy Policy, Shipping Policy and Return and Refund Policy.
Nothing in these Terms excludes or restricts your statutory consumer rights.
Nae hidden surprises. Just clear terms for shopping with us.
1. Access and Customer Accounts
You must be legally capable of entering into a purchase contract to place an order.
You agree to provide accurate and complete information when creating an account, placing an order or contacting us.
If you create an account, you are responsible for keeping your login details secure and notifying us promptly if you suspect unauthorised access.
You must not transfer your account to another person without our permission.
2. Our Products
We make reasonable efforts to describe and display our products accurately.
Please note that colours and visual details may appear slightly different depending on your device, screen settings and lighting.
Minor production variations may occur, but this does not affect your right to receive goods that are of satisfactory quality, fit for their intended purpose and as described.
Product availability, designs and prices may change for future orders.
Any changes affecting an order already accepted will be handled fairly and in accordance with applicable law.
3. Made-to-Order Products
Many of our T-shirts are printed individually after an order has been placed.
Please check your selected design, size, colour and delivery details carefully before ordering.
Where we offer genuinely personalised products using customer-supplied names, wording, artwork or other specifications, you are responsible for ensuring that the information submitted is accurate and that you have permission to use any supplied content.
Printing a standard catalogue design after purchase does not automatically remove your statutory cancellation rights.
Certain genuinely personalised or bespoke goods may be excluded from statutory change-of-mind cancellation rights where permitted by law.
Your rights concerning faulty, incorrect or misdescribed goods remain unaffected.
4. Placing an Order
When you submit an order, you offer to purchase the selected products at the price displayed during checkout.
We will send an order acknowledgement or confirmation by email.
A purchase contract is formed when we accept your order, normally by issuing an order acceptance confirmation or confirming that it has entered production.
We may decline an order where there is a legitimate reason, including product unavailability, suspected fraud, an obvious pricing error or an unavailable delivery destination.
If payment has already been taken for an order we cannot fulfil, we will issue an appropriate refund.
We will not unilaterally change the agreed price or essential product details after contract formation without an appropriate legal basis or your agreement.
5. Prices, Payments and Charges
Prices for our Great Britain storefront are displayed in British pounds sterling (GBP).
The total amount payable, including applicable taxes and compulsory delivery charges, will be disclosed before you confirm your purchase.
Our currently configured standard delivery charge is £3.99, with free standard delivery on qualifying orders of £60 or more, subject to the conditions displayed at checkout.
You will not be charged undisclosed additional fees without your agreement.
Payment is processed through the secure payment methods available at checkout.
We do not normally receive or store complete payment-card details.
If we discover a material pricing error, we will contact you and explain the available options rather than imposing an unexpected charge.
6. Discounts and Promotions
Promotions and discount codes may be subject to specific conditions, including validity dates, eligible products, minimum spending requirements or restrictions on combining offers.
Any important conditions will be explained as part of the promotion.
We may refuse fraudulent or unauthorised use of discount codes, subject to applicable law.
Promotional terms do not reduce your statutory consumer rights.
7. Production, Shipping and Delivery
We currently deliver to England, Scotland and Wales through our Great Britain storefront.
Our products are printed to order, meaning production time is separate from delivery transit time.
Standard delivery is estimated at 3–5 business days after dispatch, with production time additional.
These times are estimates unless a particular delivery date has been expressly agreed.
We will comply with the delivery requirements applicable under UK consumer law, including the general requirement to deliver within 30 days unless another timeframe has been agreed.
If your order is significantly delayed, contact us so that we can investigate and explain your available options.
You may have the right to request delivery within an appropriate additional period or cancel the contract where the law permits.
8. Responsibility for Deliveries
We are responsible for your goods until they come into your physical possession or that of a person you have identified to receive them, subject to applicable legal exceptions.
If a parcel is lost or damaged in transit, contact us and we will investigate with the carrier.
A parcel being marked as delivered by a carrier does not automatically establish that our legal delivery obligations have been fulfilled.
If you provide an incorrect delivery address, we will assess the circumstances and advise you of any available redelivery arrangements.
Any additional charges will be reasonable, explained in advance and subject to applicable consumer law.
Further information is available in our Shipping Policy.
9. Cancellations, Returns and Refunds
For standard, non-personalised products purchased online, you generally have a statutory right to cancel within 14 days of receiving the goods without giving a reason.
You normally have a further 14 days to return the goods after notifying us of cancellation.
Certain exceptions may apply to genuinely personalised or bespoke goods.
Our 30-Day Guarantee and Free Size Exchanges within 30 days of receipt are additional customer benefits and do not replace your statutory rights.
If goods are faulty, damaged, incorrect or not as described, you may have rights to a refund, repair, replacement or other remedy under the Consumer Rights Act 2015.
To arrange a cancellation, exchange or return, contact:
clientservice@naescotlandnaeparty.com
You do not need to provide a reason when exercising an applicable statutory change-of-mind cancellation right.
Please refer to our Return and Refund Policy for the full procedure, applicable return-postage arrangements and refund deadlines.
10. Intellectual Property
Our website, branding, logos, product designs, illustrations, artwork, photographs, graphics, slogans and written content may be protected by copyright, trademark and other intellectual-property rights.
Unless expressly stated otherwise, these materials are owned by us, licensed to us or used with permission.
You must not reproduce, commercially exploit, distribute, modify or manufacture products using our protected content without authorisation.
Purchasing a T-shirt does not transfer ownership of the intellectual property associated with its design.
You're buying the T-shirt — not adopting the artwork and taking it home as your own wee copyright.
11. Customer-Submitted Content
If you provide artwork, wording, photographs or other material for a product or service, you confirm that you own the relevant rights or have permission to use that material.
You agree not to submit unlawful, infringing, abusive, defamatory or otherwise prohibited content.
We may use submitted material as reasonably necessary to process and fulfil your order.
We may refuse content that we reasonably believe would violate applicable law or another person's rights.
We will not treat the submission of material for an order as general permission to use it in unrelated advertising without an appropriate basis.
12. Reviews and Feedback
You may choose to submit product reviews, photographs, comments or suggestions.
You confirm that any material you submit is accurate to the best of your knowledge and that you have the right to share it.
Where you voluntarily submit content for public display, you give us a non-exclusive, worldwide, royalty-free licence to display and use that content in connection with our store and marketing, subject to applicable law.
You retain ownership of your original content.
We may moderate or remove content where reasonably necessary, including material that is unlawful, misleading, abusive or infringing.
13. Third-Party Tools
Our website may offer features or tools provided by third parties.
These may be subject to separate terms and privacy policies.
We are not responsible for independent third-party services beyond the obligations imposed on us by applicable law.
Your statutory rights concerning products purchased directly from us remain unaffected.
14. External Links
Our website may contain links to third-party websites.
We do not control the content, privacy practices or availability of independent websites.
Links do not necessarily imply endorsement.
Please review the relevant terms and privacy policies before using external services.
15. Shopify's Role
Our store is powered by Shopify.
Shopify provides the e-commerce platform and supporting services but is not the seller of products purchased directly from Nae Scotland, Nae Party.
We remain responsible for our obligations to customers under the purchase contract and applicable consumer law.
16. Privacy and Personal Information
We collect and use personal information as described in our Privacy Policy.
Information required for payment processing, order fulfilment and customer service may be shared with relevant service providers, including Shopify, payment processors, print-on-demand providers and delivery carriers.
Your privacy rights and our data-protection responsibilities are explained in the Privacy Policy.
17. Errors and Inaccuracies
We make reasonable efforts to maintain accurate product descriptions, prices, delivery information and other website content.
If an error affects an order, we will explain the situation and provide an appropriate resolution in accordance with the contract and applicable law.
We will not use a website error as a general basis to remove consumer rights or impose unexpected charges.
18. Prohibited Uses
You may not use our website to:
-
Break applicable laws.
-
Infringe intellectual-property rights.
-
Submit fraudulent or misleading information.
-
Impersonate another person.
-
Transmit viruses or malicious software.
-
Harass, threaten or abuse others.
-
Send spam or unauthorised commercial messages.
-
Attempt to interfere with website security.
-
Scrape, reproduce or commercially exploit protected website content without permission.
-
Use our services for unlawful or harmful purposes.
We may restrict access where reasonably necessary to protect our website, customers and legal rights.
19. Suspension and Termination
You may stop using our website or account services at any time.
We may suspend or restrict access where reasonably necessary because of fraud, unlawful conduct, serious breaches of these Terms or security concerns.
Termination of website access does not automatically cancel an existing purchase contract or remove rights and obligations that have already arisen.
20. Website Availability
We aim to keep our website secure, accurate and available.
However, we cannot guarantee uninterrupted access to the website or that every online feature will always be error-free.
We may carry out maintenance or temporarily restrict access where reasonably necessary.
This section does not affect our obligations concerning products ordered or your statutory consumer rights.
21. Liability and Consumer Protections
Nothing in these Terms excludes or restricts liability where doing so would be unlawful.
In particular, we do not exclude or restrict liability for:
-
Death or personal injury caused by negligence where liability cannot legally be excluded.
-
Fraud or fraudulent misrepresentation.
-
Goods that fail to meet statutory requirements.
-
Breaches of your statutory rights concerning delivery, ownership or risk.
-
Any other liability that cannot legally be excluded or limited.
We are responsible for losses caused by our breach of contract or failure to use reasonable care and skill where those losses are reasonably foreseeable, subject to applicable law.
We are not generally responsible for losses arising solely from matters outside our reasonable control where the law does not place responsibility on us.
Our products are primarily intended for personal and domestic use. If you intend to purchase for a commercial purpose, please contact us before ordering.
No arbitrary order-value cap applies where it would limit a consumer remedy or liability that cannot lawfully be restricted.
22. Your Responsibility for Unlawful Conduct
If you deliberately misuse our services, submit material that infringes another person's rights or engage in unlawful activity, you may be responsible for losses directly caused by that conduct to the extent permitted by law.
Nothing in this section creates an unlimited obligation to compensate us or third parties or restricts your statutory rights.
23. Severability
If part of these Terms is found to be unlawful or unenforceable, that provision will not apply to the extent required by law.
The remaining provisions will continue to apply where they can operate fairly and lawfully.
24. Entire Agreement and Waiver
These Terms, together with applicable policies and the information presented to you before purchase, set out the contractual terms governing your order.
Nothing in this section removes rights arising from statements, representations or information that form part of the contract under applicable law.
If we do not immediately enforce a contractual right, that does not necessarily mean we have permanently waived it.
25. Assignment
We may transfer the operation of our business or applicable contractual obligations as part of a legitimate sale or restructuring, provided your rights are preserved in accordance with applicable law.
You may not transfer an account or purchase contract to another person without our agreement, except where the law provides otherwise.
26. Governing Law and Disputes
Our business is operated from Singapore.
These Terms are intended to be governed by Singapore law, without depriving customers in Great Britain of mandatory consumer protections that apply to their purchase under UK law.
Nothing in these Terms requires a consumer to bring proceedings exclusively in Singapore where applicable law permits proceedings in the courts of England and Wales or Scotland.
If you experience a problem, please contact us first so that we can try to resolve it promptly and fairly.
This does not prevent you from exercising any legal right to bring a claim or seek assistance from an appropriate consumer authority.
27. Changes to These Terms
We may update these Terms to reflect changes to our business, website, services or legal requirements.
Updated Terms will be published on our website with a revised date.
Changes will not retrospectively remove contractual or statutory rights relating to orders already placed.
